Srinagar: In a major setback to Jammu and Kashmir Bank, the High Court has quashed the retrospective dismissal of retired officer Naseer Ahmad Sheikh, citing serious violations of due process and natural justice.
Justice Javed Iqbal Wani observed that Sheikh, who retired in June 2021 after over three decades of service, was wrongfully dismissed in April 2022 following flawed disciplinary proceedings. The court noted that he was denied the chance to defend himself, as key witnesses were not summoned and relevant evidence was ignored.
The core charges related to temporary overdrafts sanctioned by Sheikh were not substantiated, with the court noting his claim of acting on verbal directions from seniors was never investigated.
Terming the inquiry “prejudged” and “procedurally defective,” the court directed the bank to release all pensionary benefits within eight weeks or face 8 percent annual interest on the pending amount.
The ruling highlights the need for fairness and accountability in institutional inquiries, especially when they affect post-retirement entitlements. (CNS)
