Srinagar, Nov 1: City Judge Srinagar, Abdul Bari, has convicted former Managing Director of J&K Cooperative Central Land Development Limited, Mohammad Shafi Banday, for manipulating his date of birth to unlawfully extend his service tenure. The court sentenced him to two years of simple imprisonment along with a fine.

According to officials, the case originated from a communication received by the Crime Branch Kashmir and Railways on October 15, 2012, alleging that Banday had fraudulently shown his date of birth as September 1, 1939, instead of 1934 by producing a fake certificate. Departmental verification confirmed the manipulation through multiple official correspondences.

The investigation revealed that Banday had overstayed in service by more than seven years, causing wrongful gain to himself and loss to the state exchequer. Consequently, Crime Branch Srinagar registered FIR No. 49/2007 against him under Sections 201, 420, 468, and 471 of the Ranbir Penal Code (RPC). A chargesheet was subsequently filed before the court, and charges were formally framed on August 26, 2013.

After a detailed trial, the City Judge held that the prosecution successfully proved its case beyond reasonable doubt. Banday was convicted under Sections 420, 468, and 471 RPC.

The court sentenced him to simple imprisonment for two years and imposed a fine of Rs. 5,000 under each of the three sections. In default of payment of fine, the accused will undergo an additional six months of simple imprisonment. The court ordered that all sentences shall run concurrently
