Kasganj, June 8 : In a significant order aimed at ensuring police accountability, a court in Uttar Pradesh has directed the registration of a First Information Report (FIR) against a Station House Officer (SHO) accused of illegally detaining a man and manipulating official records to justify the unlawful custody.
The order was passed by Chief Judicial Magistrate (CJM) of Kasganj, Khan Zishan Masood, who observed that the police officer had allegedly detained the complainant without legal authority for more than two days and subsequently fabricated General Diary (GD) entries to cover up the illegal act.
The case stems from a complaint filed on behalf of Sanjay Yadav, who alleged that he was picked up by police on April 28, 2026, and kept in custody without following due legal procedure. The complainant further claimed that he was denied access to legal assistance during the period of detention.
Rejecting the SHO’s claim of protection under the discharge of official duties, the CJM held that unlawful detention and the creation of false records could not be treated as actions performed in the line of duty.
The court observed that “illegal detention without any authority of law and making false and fictitious GD entries cannot be considered acts done in discharge of official duty,” thereby paving the way for criminal proceedings against the officer concerned.
The June 3 order directed that an FIR be registered against the SHO at the same police station where he was posted, underscoring the judiciary’s firm stand against abuse of power and misuse of official position by law enforcement personnel.
The ruling has been viewed as a strong reminder that police officials remain answerable under the law and cannot claim immunity for actions that violate constitutional and legal safeguards guaranteed to citizens. (KNC)
