SRINAGAR, MAY 16: Under the patronage of Justice Arun Palli, Chief Justice, High Court of Jammu & Kashmir and Ladakh and Patron-in-Chief, J&K Judicial Academy, a one-day training programme on the Code of Civil Procedure was conducted today at the J&K Judicial Academy, Moominabad, Srinagar, for Judicial Officers of Kashmir Province under the guidance of the Chairman and Members of the Governing Committee of the Academy.
Justice Rajnesh Oswal, Judge, High Court of J&K and Ladakh and Chairman, J&K Judicial Academy, in his keynote address, observed that the Code of Civil Procedure, though procedural in nature, is rooted in the principles of natural justice and serves as an effective instrument for implementation of substantive law.


He emphasized that civil adjudication is foundational to a progressive civil society and stressed the need for judicial officers to handle civil litigation with procedural discipline, sensitivity and commitment. Referring to Section 89 CPC, He highlighted the importance of Alternate Dispute Resolution mechanisms in facilitating amicable settlement of disputes and ensuring accessible and efficient justice delivery.


Naseer Ahmad Dar, Director, J&K Judicial Academy, in his welcome address, stated that the Code of Civil Procedure forms the backbone of civil adjudication and its effective application is essential for fair, efficient and timely administration of justice. He informed that the programme was designed to deliberate upon practical application of procedural provisions, strengthen judicial efficiency, improve case management and reduce delays in civil trials. He further stated that the sessions would focus on pre-trial proceedings, framing of issues, pleadings, admissions and procedural tools available under the CPC for effective adjudication.


The first and second technical sessions were delivered by Justice Mohammad Yaqoob Mir, Former Chief Justice, High Court of Meghalaya, on “Role of Court in Pre-Trial Proceedings and Effective Case Facilitation” and “Case Management, Framing of Issues and Discovery Procedures.” He emphasized the importance of judicial intervention in effective pre-trial management for narrowing controversies and ensuring expeditious disposal of civil cases.


The sessions covered examination of parties under Order X CPC, use of Section 89 CPC for Alternate Dispute Resolution, summoning and attendance of witnesses under Order XVI CPC, framing of issues under Order XIV CPC and discovery and inspection under Order XI CPC.
The concluding session was delivered by Mohammad Ashraf Malik, Former District and Sessions Judge, on “Pleadings, Admissions and Expeditious Adjudication.” The resource person emphasized the importance of continuous judicial learning, effective case management and procedural discipline in civil adjudication. Drawing from his judicial experience, he highlighted challenges arising from heavy dockets, prolonged litigation and procedural delays, and stressed that such delays can be minimized through timely judicial intervention, proper prioritization of cases and effective exercise of judicial discretion. He underscored the importance of pleadings, admissions and procedural mechanisms under the CPC in narrowing controversies and facilitating expeditious adjudication.


All the technical sessions were followed by interactive discussions wherein participating Judicial Officers engaged with the resource persons on practical and procedural challenges in civil adjudication.
The programme provided a valuable platform for exchange of ideas and deliberations aimed at ensuring efficient and expeditious justice delivery.
