Awantipora, Feb 12: In a cheque fraud case dating back to 2019, the Court of Additional Special Mobile Magistrate Awantipora on Thursday convicted two persons and sentenced them to one year of simple imprisonment along with a substantial fine of Rs 28,08,000

In a case that dates back to 2019 titled Mukhtar Ahmad Sheikh vs Ess Kay Filling Station & another, Additional Special Mobile Magistrate Awantipora Muneer Ahmad Bhat convicted Muhammad Sultan Koka S/o Gh Mohd Koka R/o Parraypora Majeedbagh Srinagar and Abid Yousuf Dar S/o Mohammed Yousuf Dar R/o Wuyan Pampore.
ASMM Awantipora held that the accused duo knowingly issued a fraudulent cheque to the complainant Mukhtar Ahmad Sheikh S/o Gh Mohd Sheikh R/o Noorpora Awantipora
The court observed that the accused persons had intentionally and willfully issued a cheque that he was aware would be dishonoured, thereby causing financial loss to the complainant. “The accused issued the cheque not only with knowledge of its likely dishonour but also for his personal gain,” the court noted while delivering the judgment.

After examining multiple witnesses, the court sentenced the accused to simple imprisonment for a period of one year. In addition, the court imposed a fine of Rs 28,08,000 along with 6% interest from the date of issuance of the cheque till the date of judgment.

The court directed that the entire amount be paid to the complainant within three months from the date of announcement of judgement. In case the accused fails to liquidate the amount within the timeframe, they shall have to undergo further additional imprisonment for three months.
