Special NDPS Court Imposes ₹1 Lakh Fine on Convict; Prosecution Opposes Bail Citing Applicant’s Criminal History

Jammu, October 21: The Jammu and Kashmir Prosecution Department has secured a major conviction in a commercial quantity narcotics case, with the Special Judge, NDPS Court, Jammu, sentencing an accused to 10 years of rigorous imprisonment for possessing 3 kilograms of charas. In a separate development, the Chief Judicial Magistrate, Samba, rejected the bail application of another accused after the prosecution highlighted his criminal history, which reportedly includes 15 pending First Information Reports (FIRs).

The two developments underline the prosecution’s role in presenting evidence before courts and opposing bail pleas on the basis of relevant facts and circumstances.

ACCUSED SENTENCED TO 10 YEARS IN COMMERCIAL QUANTITY CHARAS CASE

According to details, the Special Judge, NDPS Court, Jammu, Parvaiz Iqbal, on October 19, 2026, convicted Mohd Asif in connection with FIR No. 93/2020, registered at Police Station Akhnoor under Section 8/20 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

The case pertained to the seizure of 3 kilograms of charas, classified as a commercial quantity under the applicable provisions of the NDPS Act.

The prosecution was represented by Special Public Prosecutor Sunil Kumar, who presented the case before the court and established the accused’s conscious possession of the contraband.

During the proceedings, the prosecution presented evidence to substantiate the charges and established the chain of custody of the seized narcotics, supporting the case against the accused.

After examining the evidence and considering the prosecution’s submissions, the court convicted Mohd Asif and sentenced him to 10 years of rigorous imprisonment. The court also imposed a fine of ₹1,00,000.

The conviction marks a significant outcome in the prosecution of offences involving commercial quantities of narcotic substances.

SAMBA COURT REJECTS BAIL PLEA OF ACCUSED WITH 15 PENDING FIRs

In a separate case, the Chief Judicial Magistrate, Samba, Smriti Sharma, rejected the bail application of Mehboob Akhter in connection with FIR No. 68/2026, registered at Police Station Ghagwal under Sections 331(3) and 305 of the Bharatiya Nyaya Sanhita (BNS).

Assistant Public Prosecutor Megha Rani represented the prosecution and opposed the bail application, drawing the court’s attention to the applicant’s reported criminal history, which includes 15 pending FIRs.

The prosecution also pointed out alleged factual discrepancies in the bail application and argued that the relief sought should not be granted in view of the circumstances brought before the court.

After considering the submissions made by the prosecution and examining the matter, the court rejected the bail plea.

The decision came after the prosecution placed the applicant’s reported criminal antecedents and other relevant circumstances before the court for consideration.

PROSECUTION REAFFIRMS COMMITMENT TO RULE OF LAW

The two developments highlight the Jammu and Kashmir Prosecution Department’s efforts to pursue criminal cases, present evidence before courts and oppose bail applications where the circumstances warrant judicial scrutiny.

The department reiterated its commitment to upholding the rule of law, combating drug trafficking and other criminal activities, and ensuring effective legal representation in criminal proceedings.

The conviction in the commercial quantity charas case highlights the importance of evidence collection, preservation of the chain of custody and effective presentation of prosecution evidence. Meanwhile, the rejection of the bail application in Samba underscores the role of judicial scrutiny in assessing the circumstances of individual cases.

Together, the two outcomes reflect the continued role of prosecution agencies and the judiciary in addressing criminal offences and advancing the administration of justice across Jammu and Kashmir.(KNC)
