Srinagar, August 17: The Jammu and Kashmir Anti-Corruption Bureau (ACB) has filed a chargesheet against 10 accused persons, including seven officers of the Srinagar Municipal Corporation (SMC) and three private individuals, in connection with an alleged illegal and unauthorised construction in Ward No. 28, Batamaloo, Srinagar, near Tiny Hearts School, Tengpora.
The chargesheet in FIR No. 06/2023 of Police Station ACB Srinagar has been presented before the Court of the Special Judge, Anti-Corruption, Srinagar, for judicial determination.
The accused have been booked for alleged offences under Section 5(1)(d) read with Section 5(2) of the J&K Prevention of Corruption Act, Samvat 2006, Section 120-B of the Ranbir Penal Code, Section 4-A of the R&D Act, and Section 9-A read with Section 20 of the Evacuees (Administration of Property) Act, 1949.
According to the ACB, the case was registered following allegations that officers and officials associated with Ward No. 28 of the Srinagar Municipal Corporation allegedly abused their official positions and entered into a criminal conspiracy with a private beneficiary, Reyaz Ahmad Dar, son of Abdul Rahim Dar, resident of Tengpora, Batamaloo, Srinagar.
The investigation alleged that the accused public servants facilitated and permitted the raising of illegal and unauthorised construction in the area near Tiny Hearts School, Tengpora, in violation of the applicable rules and regulations.
The ACB said that the investigation conducted by Police Station ACB Srinagar, based on oral and documentary evidence, substantiated the allegations levelled against the accused officers and private beneficiaries.
The investigation, according to the anti-corruption agency, established the alleged criminal conspiracy between the government functionaries and the private beneficiary, along with the abuse of official position and extending of undue benefit.
After obtaining the requisite sanction for prosecution of the public servants from the Government, the ACB produced the chargesheet against all 10 accused persons, including the three private individuals, before the Special Judge, Anti-Corruption, Srinagar, for judicial determination.
The matter will now be considered by the competent court in accordance with law.(KNC)
