Court Says Rarest of Rare Threshold Not Met, Stresses Scope for Reformation of Convict

GANDERBAL, OCTOBER 15: The Court of Additional Sessions Judge, Ganderbal, has sentenced Mohammad Shafi Magray, a resident of Chundina, Ganderbal, to imprisonment for life in a murder case involving the killing of Mohammad Yousuf Khanday, while declining the prosecution’s plea for the death penalty.

The sentencing order was passed by Additional Sessions Judge Fozia Paul on October 15, 2026, following the conviction of Magray on September 30, 2026, under Sections 302, 379 and 201 of the Ranbir Penal Code (RPC). The accused was acquitted of the charge under Section 364 RPC.

PROSECUTION SEEKS DEATH PENALTY

During the sentencing proceedings, the prosecution sought the maximum punishment, including the death penalty, citing the alleged financial motive behind the crime, the fatal head injury sustained by the deceased, the subsequent use of the deceased’s ATM card, concealment of property and destruction of evidence.

The prosecution argued that the circumstances surrounding the crime warranted the imposition of the severest punishment available under the law.

COURT DECLINES CAPITAL PUNISHMENT

After examining the circumstances of the case and the material placed before it, the court acknowledged the seriousness of the offence and the aggravating circumstances highlighted by the prosecution.

However, the court held that the prosecution had failed to establish that life imprisonment would be unquestionably inadequate or that the convict was beyond the possibility of reformation.

Applying the Supreme Court’s “rarest of rare” doctrine, the court concluded that the exceptional threshold required for imposing the death penalty had not been met.

The court observed that the gravity of a murder, however serious, cannot by itself justify capital punishment without a careful assessment of the circumstances of the case and the possibility of reforming the convict.

REFORMATION AND REHABILITATION CONSIDERED

While determining the appropriate sentence, the court emphasised that the prospects of reformation and rehabilitation must be seriously considered before a death sentence is imposed.

The court took into account several mitigating factors, including the absence of an established previous conviction, the convict’s age of approximately 45 years, his family circumstances, the substantial period of custody already undergone and the absence of material demonstrating that he was incapable of reform.

It further observed that the absence of an adverse prison-conduct report could not, by itself, be treated as proof of exemplary conduct or completed rehabilitation.

Nevertheless, the court noted that the sentencing record did not contain sufficient material to establish that the convict was beyond reformation.

LIFE IMPRISONMENT UNDER SECTION 302 RPC

Concluding that the legal requirements for imposing the death penalty had not been satisfied, the court sentenced Mohammad Shafi Magray to imprisonment for life under Section 302 RPC.

The decision reiterates the judicial principle that capital punishment is reserved for exceptional cases in which the prescribed legal threshold is satisfied, and that the possibility of reformation remains a significant consideration during sentencing.

Additional Public Prosecutor Ms. Shafaq Murtaza represented the prosecution, while Advocate S. M. Mustahseen & Associates appeared on behalf of the convict.(KNC)
