Srinagar, Oct 5 (GNS): The Government of Jammu and Kashmir has ordered fresh regular departmental action against Arshad Amin S/o Late Mohammad Amin R/o Thathri District Doda, the then Junior Engineer (REW) BDO Office Changa, Tehsil Gandoh District Doda, for commission of offences punishable under Section 7 of Prevention of Corruption Act, 1988 in FIR No.06/2021 P/S ACB Central Jammu.
As per Government Order, a copy of which lies with GNS, the JE (REW) was arrested by ACB in case FIR No.06/2021. Acting on advice of General Administration Department, the Department of Rural Development and Panchayati Raj had framed and served Memorandum, Articles of Charges and Statement of Imputation upon the delinquent through Joint Director (Administration), RD Jammu, and his defence statement was found unsatisfactory.
The RD&PR Department vide Order No. 36-RD&PR of 2025 dated 04.02.2025 had appointed Assistant Commissioner (Development), Kishtwar as Inquiry Officer, who submitted his report. On examination, various shortcomings were observed and clarifications were sought. The RD&PR later shared records vide O.M dated 21.07.2026 and recommended imposition of penalty under Rule-30 of J&K Civil Services (CC&A) Rules, 1956 for gross misconduct.
The GAD had also accorded sanction of prosecution vide order dated 23.06.2023.
After examination of relevant factors and records shared by RD&PR and ACB J&K, the Public Works (R&B) Department, being the Disciplinary/Appointing Authority, rejected the findings of the inquiry report submitted by ACD Kishtwar and decided to hold a fresh inquiry by adopting the formal Memorandum and Articles of Charges already served by RD&PR on post-facto basis.
Now with approval of Competent Authority, sanction has been accorded for institution of simultaneous regular departmental action against the delinquent JE (REW) and appointment of Er. Shivangi Gupta, In-charge Superintending Engineer PMGSY Batote as Inquiry Officer and Er. Suresh Bharti, In-charge Executive Engineer RDD Doda as Presenting Officer.
The Inquiry Officer has been directed to submit her report along with clear-cut recommendations within one month as per CVC guidelines. Any transfer of IO/PO shall not affect the inquiry.
The order has been issued by order of the Government of Jammu and Kashmir.(GNS)
