Denying pre-arrest bail to a man accused of assaulting his spouse, the Supreme Court on Monday said a husband would be primarily liable for injuries inflicted on a wife in the matrimonial home even if these were caused by his relatives.
The apex court made these remarks while hearing a man’s application seeking for anticipatory bail. The man approached the Supreme Court after the Punjab and Haryana High Court had refused to grant anticipatory bail to him.
The man’s wife lodged a complaint in June last year. She had alleged that her husband, father-in-law and mother-in-law assaulted her because she could not fulfill their growing dowry demands.
