President Notifies Reservation Cap of 85% for Ladakh in Gazette Regulation

New Delhi, Jun 3 The President of India has promulgated the Union Territory of Ladakh Reservation (Amendment) Regulation, 2025, which formally amends the Jammu and Kashmir Reservation Act, 2004 as it applies to the Union Territory of Ladakh, according to the Gazette of India issued by the Ministry of Law and Justice on June 2, 2025.

As per the Gazette notification a copy of which lies with news agency JKNS reads, “This Regulation may be called the Union territory of Ladakh Reservation (Amendment) Regulation, 2025.” It further states that “It extends to the whole of the Union territory of Ladakh.” The Gazette specifies that “It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint.”

The regulation introduces amendments to the Jammu and Kashmir Reservation Act, 2004. In section 3, in sub-section (1), the first proviso is substituted to state: “Provided that the total percentage of reservation shall in no case exceed 85%, excluding reservation for Economically Weaker Sections:”.

Further, the regulation amends section 5 of the principal Act. It reads: “(a) in sub-section (1), the second proviso shall be omitted; (b) after sub-section (4), the following sub-section shall be inserted, namely: ‘(5) Nothing contained in this section shall apply to Economically Weaker Sections and filling up of vacancies for such Sections shall be in such manner as may be prescribed.’”

In section 6 of the principal Act, for the first proviso, the following is substituted:
“Provided that the total percentage of reservation shall in no case exceed 85% of the available vacancies, excluding reservation for Economically Weaker Sections:”.

Section 9 of the principal Act is also amended. In sub-section (1), for the first proviso, the Gazette notifies the following substitution:
“Provided that the total percentage of reservation shall in no case exceed 85%, excluding reservation for Economically Weaker Sections:”.

The Gazette adds that the regulation was “Promulgated by the President in the Seventy-sixth Year of the Republic of India.” It is titled: A Regulation further to amend the Jammu and Kashmir Reservation Act, 2004 in its application to the Union territory of Ladakh.

It is promulgated “In exercise of the powers conferred by article 240 of the Constitution read with sub-section (2) of section 58 of the Jammu and Kashmir Reorganisation Act, 2019, the President is pleased to promulgate the following Regulation made by her.” (JKNS)
