Court Says Bail Application Failed to Comply With High Court’s Prescribed Disclosure Requirements

Jammu, Oct 7: The Court of the 1st Additional Sessions Judge, Jammu, has dismissed an application seeking anticipatory bail, after finding that the petitioner had failed to comply with the mandatory disclosure requirements prescribed by the High Court of Jammu & Kashmir and Ladakh.

The court observed that the bail application did not fulfil the requirements laid down under the amended rules concerning mandatory disclosures in bail matters.

The High Court of Jammu & Kashmir and Ladakh, through Notification No. 1399 of 2026/RG, has amended the relevant rules and prescribed certain mandatory disclosures to be made in bail applications.

The amended requirements are intended to ensure that courts receive complete, candid and relevant information while considering applications for bail. These disclosures include material particulars concerning the applicant, including criminal antecedents and other relevant proceedings, wherever applicable.

While dealing with the present anticipatory bail application, the Jammu Court noted that the petitioner had not complied with the mandatory requirements prescribed under the High Court notification.

The court consequently held that the application was non-compliant with the prescribed procedural requirements and dismissed the anticipatory bail plea.

Importantly, the dismissal was based on the petitioner’s failure to comply with the mandatory disclosure requirements and was not an adjudication on the merits of the allegations involved in the underlying case.

The order underscores the importance of complying with the procedural requirements governing bail applications, particularly where the High Court has specifically prescribed mandatory disclosures to facilitate proper and informed judicial consideration.

The court’s decision also highlights that applicants seeking anticipatory bail are required to place the prescribed material particulars before the court in accordance with the applicable rules and directions.(KNC)
